1. Eligibility & age

You must be at least 13 years old to use Virtual Geocache. If you are between 13 and the age of majority where you live, you may use the Service only with the knowledge and consent of a parent or legal guardian who agrees to these Terms on your behalf and accepts responsibility for your use.

The Service is not intended for, and may not be used by, children under 13. By using the Service, you represent that you meet these requirements and that the information you provide is accurate.

2. The Service & your license to use it

Virtual Geocache is an augmented-reality treasure hunt that guides you to physical locations to discover virtual caches. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to download, install, and use the app for your personal, non-commercial enjoyment.

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice, and we have no obligation to provide or continue any particular feature.

3. Your account

You sign in using a third-party provider (Google or Apple). You are responsible for activity under your account and for keeping your sign-in secure. Tell us promptly if you believe your account has been compromised. We may suspend or terminate your account if you violate these Terms or to protect the Service or other users.

You may stop using the Service and delete your account at any time. See our Privacy Policy for how your data is handled when you do.

4. Safety & assumption of risk

Virtual Geocache is a real-world activity. It encourages you to travel to physical locations and to view your surroundings through your device's camera. You participate entirely at your own risk and are solely responsible for your own safety and conduct.

While using the Service, you agree that you will:

• stay aware of your surroundings at all times and keep your head up;
• not use the Service while driving, cycling, skating, operating machinery, or doing anything else that requires your full attention;
• obey all laws, signs, and posted rules, and not trespass on or enter private, restricted, dangerous, or prohibited property or areas to reach a cache;
• watch for hazards including traffic, other people, animals, water, drop-offs, cliffs, uneven or slippery terrain, weather, and wildlife;
• respect the rights, privacy, and peace of other people and their property; and
• use common sense and stop if continuing would be unsafe or unlawful.

4a. We don't guarantee locations are safe

Cache locations, distances, and the timing of any reveal are approximate and may be inaccurate. We do not guarantee that any location is safe, lawful to access, accessible, or free of hazards, and we do not direct you to any specific spot. You — not Virtual Geocache — are responsible for choosing safe routes and behaving safely.

To the fullest extent permitted by law, you knowingly and voluntarily assume all risks of using the Service and of your real-world activities while doing so — including the risk of personal injury, death, or property damage — and you release RaptorView, LLC and its operators from any liability arising out of those risks. If you use the Service with or on behalf of a minor, you assume these risks on their behalf.

5. Community rules & responsible play

Virtual Geocache depends on respect — for people, places, and nature. You agree to:

• Leave it better than you found it — follow “Cache In, Trash Out” principles and don't damage or litter the environment.
• Respect private property and posted rules; don't trespass, climb, dig, or disturb property or habitats to find a cache.
• Be considerate of residents, businesses, and other players around you.
• Not use the Service for any unlawful, harmful, harassing, hateful, or fraudulent purpose.
• Not interfere with, overload, reverse-engineer, scrape, or attempt to gain unauthorized access to the Service or its data.

6. Your content

The Service lets you capture and share photos of your finds and provide profile information ("User Content"). You keep ownership of your User Content. By submitting it, you grant RaptorView, LLC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that User Content for the purpose of operating, providing, and improving the Service (for example, showing your find photos in your own collection).

You are responsible for your User Content and represent that you have the rights to it. Don't submit content that is illegal, infringing, hateful, harassing, sexually explicit, or that depicts other identifiable people without their permission. We may remove User Content that violates these Terms.

7. Your suggestions

Any feedback, comments, ideas, or suggestions about the Service ("Suggestions") that you choose to send us are non-confidential, and you grant us the right to use them for any purpose without obligation or compensation to you. This section applies only to such Suggestions — not to your find photos or other User Content, which are governed by Section 6.

8. Purchases

The Service is currently free to use. If we offer any paid features or in-app purchases in the future, they will be sold and processed through the Apple App Store or Google Play, and all payments, billing, and refunds will be handled by those platforms under their terms and refund policies — not by us. Any additional terms for paid features will be presented to you at the time of purchase.

9. Intellectual property

The Service and its contents — including software, text, images, audio, 3D models, design, branding, and their selection and arrangement — are owned by RaptorView, LLC, its licensors, or other providers, and are protected by intellectual-property laws. You may not copy, modify, reproduce, download, or distribute them except as expressly permitted by these Terms. Third-party 3D models and assets remain the property of their creators and are used under their respective licenses.

10. Third-party services

The Service relies on and may link to third-party services — including Google (sign-in, maps, and cloud hosting) and Apple (sign-in) ("Third-Party Services"). We are not responsible for Third-Party Services, including their accuracy, legality, or content, and you access them at your own risk and subject to their own terms and privacy policies.

11. Updates to the app

We may provide patches, bug fixes, updates, or upgrades ("Updates") that modify or remove features. Updates are part of the app and subject to these Terms. We have no obligation to provide any Update or to keep any particular feature available.

12. Termination

These Terms remain in effect until terminated by you or by us. We may suspend or terminate your access at any time, with or without notice, if you violate these Terms or to protect the Service or others. You may terminate by deleting the app and your account. Provisions that by their nature should survive termination — such as the content license in Section 6, disclaimers, limitation of liability, assumption of risk, and indemnification — will survive.

13. Disclaimers — no warranties

The Service is provided "as is" and "as available," with all faults and without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any location, content, distance, or reveal is accurate, reliable, current, or safe. Some jurisdictions don’t allow certain warranty exclusions, so some of this may not apply to you.

14. Limitation of liability

To the fullest extent permitted by law, RaptorView, LLC and its operators, suppliers, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any personal injury, death, property damage, loss of data, loss of profits, or loss of privacy, arising out of or related to your use of (or inability to use) the Service or your real-world activities while using it — even if advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $100. Some jurisdictions don't allow these limitations, so parts of this section may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless RaptorView, LLC and its operators, affiliates, and agents from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of: (a) your use of the Service; (b) your User Content; (c) your real-world conduct; or (d) your violation of these Terms or of any law or third-party right.

16. Dispute resolution & arbitration

Most concerns can be resolved quickly by contacting us. Before starting arbitration, you or we must first send a written Notice of Dispute to support@virtualgeocache.com (for notices to you, to your account email) describing the dispute and the relief requested, and the parties will try to resolve it informally within 60 days.

If it is not resolved, any dispute (except claims for injunctive or equitable relief regarding intellectual-property rights) will be settled by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association, rather than in court. You and we are each giving up the right to a trial by judge or jury and the right to participate in a class action. Either party may still seek interim injunctive relief from a court to protect its rights pending arbitration.

30-day opt-out: You may opt out of this agreement to arbitrate within 30 days of first accepting these Terms by emailing support@virtualgeocache.com with your name and a statement that you wish to opt out. Opting out won't affect any other part of these Terms.

17. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we'll update the version and effective date above and ask you to review and accept the updated Terms in the app before you continue. Your continued use after changes take effect means you accept them.

18. Governing law & general

These Terms are governed by the laws of Texas, without regard to conflict-of-laws rules, and any court proceeding permitted under these Terms will take place in the courts located in Travis County, Texas, unless applicable law requires otherwise.

If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Service. Section headings are for convenience only.
